O ministro Edson Fachin, do Supremo Tribunal Federal (STF), determinou que a prefeitura do Rio de Janeiro e a C\u00e2mara Municipal da capital fluminense prestem esclarecimentos sobre a lei que criou uma divis\u00e3o armada na Guarda Municipal do Rio de Janeiro. A contesta\u00e7\u00e3o da lei chegou ao STF ap\u00f3s dois acionamentos na justi\u00e7a. A primeira a\u00e7\u00e3o foi impetrada pela Fenaguardas, Federa\u00e7\u00e3o Nacional de Sindicatos de Servidores das Guardas Municipais. A segunda a\u00e7\u00e3o, proposta pela AGM, Associa\u00e7\u00e3o Nacional de Guardas Municipais, foi recebida na quinta-feira (26) pelo Supremo.<\/p>\n

A AGM pediu a derrubada imediata da lei, sob argumento de inconstitucionalidade, por prever o preenchimento de cargos p\u00fablicos por contrata\u00e7\u00e3o tempor\u00e1ria, sem concurso p\u00fablico e com porte funcional de arma de fogo. Para o presidente da Associa\u00e7\u00e3o Nacional de Guardas Municipais, Reinaldo Monteiro, n\u00e3o \u00e9 aceit\u00e1vel que a seguran\u00e7a p\u00fablica seja tratada com improviso e informalidade.\u00a0<\/p>\n

Na a\u00e7\u00e3o proposta pela Fenaguardas, o pedido \u00e9 para que o STF fixe o entendimento de que as atividades das guardas municipais devem ser exercidas por concursados.<\/p>\n

\u00a0A remunera\u00e7\u00e3o prevista \u00e9 de R$ 13 mil, sendo mais de R$ 10 mil como gratifica\u00e7\u00e3o por uso de arma de fogo.<\/p>\n

Procurada, a prefeitura do Rio de Janeiro respondeu que a cria\u00e7\u00e3o da divis\u00e3o de elite da Guarda Municipal est\u00e1 fundamentada pelo pr\u00f3prio STF.<\/p>\n
