{"id":16999,"date":"2025-11-27T07:47:20","date_gmt":"2025-11-27T11:47:20","guid":{"rendered":"https:\/\/divulguems.com.br\/?p=16999"},"modified":"2025-11-27T07:47:20","modified_gmt":"2025-11-27T11:47:20","slug":"stf-marca-julgamento-sobre-marco-temporal-para-5-de-dezembro","status":"publish","type":"post","link":"https:\/\/divulguems.com.br\/?p=16999","title":{"rendered":"STF marca julgamento sobre Marco Temporal para 5 de dezembro"},"content":{"rendered":"<p>O Supremo define data para in\u00edcio do julgamento que dir\u00e1 se o Marco Temporal fere ou\u00a0n\u00e3o a Constitui\u00e7\u00e3o.<img decoding=\"async\" src=\"https:\/\/agenciabrasil.ebc.com.br\/ebc.png?id=1669777&#038;o=rss\"><img decoding=\"async\" src=\"https:\/\/agenciabrasil.ebc.com.br\/ebc.gif?id=1669777&#038;o=rss\"><\/p>\n<p>O julgamento ser\u00e1 realizado de forma virtual a partir de 5 de dezembro e a vota\u00e7\u00e3o eletr\u00f4nica ficar\u00e1 aberta at\u00e9 o dia 15.\u00a0<\/p>\n<p>A data foi marcada ap\u00f3s o relator do caso, ministro Gilmar Mendes, liberar os processos.\u00a0<\/p>\n<p>Os ministros devem se manifestar sobre o texto final, aprovado pela comiss\u00e3o que debateu uma proposta de altera\u00e7\u00e3o legislativa para o tema.<\/p>\n<p>Em 2023, o STF j\u00e1 havia considerado inconstitucional o uso do Marco Temporal para demarcar terras ind\u00edgenas.<\/p>\n<p>Em seguida, o presidente Lula vetou o projeto que havia validado o marco, mas o veto foi derrubado pelo Congresso.<\/p>\n<p>Acabou prevalecendo o entendimento que os ind\u00edgenas s\u00f3 teriam direito \u00e0s terras que estavam na posse deles na data da promulga\u00e7\u00e3o da Constitui\u00e7\u00e3o Federal, em 1988, ou daquelas terras em disputa judicial na mesma \u00e9poca.<\/p>\n<p>\u00a0PL, PP e o Republicanos protocolaram no STF a\u00e7\u00f5es para manter a validade do projeto que reconhece a tese do Marco Temporal.<\/p>\n<p>\u00a0J\u00e1, representa\u00e7\u00f5es ind\u00edgenas e partidos do governo recorreram ao STF para contestar a constitucionalidade dessa tese.<\/p>\n<p>\u00a0A Funda\u00e7\u00e3o Nacional dos Povos Ind\u00edgenas, por exemplo, questiona que o Marco Temporal desconsidera situa\u00e7\u00f5es concretas, como casos de povos ind\u00edgenas expulsos das \u00e1reas de ocupa\u00e7\u00e3o tradicional e que n\u00e3o tiveram meios f\u00edsicos ou jur\u00eddicos de recorrer at\u00e9 1988.<\/p>\n<p>\u00a0<\/p>\n<p>  <span class=\"hms hms-format-m-ss\">1:29<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>O Supremo define data para in\u00edcio do julgamento que dir\u00e1 se o Marco Temporal fere ou\u00a0n\u00e3o a Constitui\u00e7\u00e3o.
