Falta o voto do ministro Gilmar Mendes.<\/p>\n<h2>Entenda<\/h2>\n<p>A <strong>Lei Maria da Penha definiu que a Justi\u00e7a deve assegurar \u00e0 mulher em situa\u00e7\u00e3o de viol\u00eancia dom\u00e9stica a manuten\u00e7\u00e3o do v\u00ednculo empregat\u00edcio por seis meses<\/strong>. A medida vale para casos em que \u00e9 necess\u00e1rio o afastamento do local de trabalho.<\/p>\n<p>No entendimento de Fl\u00e1vio Dino, a manuten\u00e7\u00e3o do v\u00ednculo trabalhista envolve a prote\u00e7\u00e3o das mulheres, incluindo a manuten\u00e7\u00e3o da renda.\u00a0<\/p>\n<p>Dessa forma, segundo o ministro, a mulher tem direito a um benef\u00edcio previdenci\u00e1rio ou assistencial, conforme o v\u00ednculo com a seguridade social.\u00a0<\/p>\n<h2>Segurada do INSS\u00a0<\/h2>\n<p>No caso de mulheres que s\u00e3o seguradas do Regime Geral de Previd\u00eancia Social, como empregada, contribuinte individual, facultativa ou segurada especial, Dino entendeu que os primeiros 15 dias de remunera\u00e7\u00e3o pelo afastamento ser\u00e1 de responsabilidade do empregador. O per\u00edodo restante fica sob a responsabilidade do INSS.<\/p>\n<p>Para quem n\u00e3o tem rela\u00e7\u00e3o de emprego, mas contribui para o INSS, o benef\u00edcio dever\u00e1 ser pago integralmente pelo \u00f3rg\u00e3o.<\/p>\n<p>N\u00e3o segurada \u2013\u00a0Dino entendeu que as mulheres que n\u00e3o s\u00e3o seguradas do INSS\u00a0dever\u00e3o receber o Benef\u00edcio de Presta\u00e7\u00e3o Continuada (BPC).
